These Terms and Conditions constitute a legally binding agreement between People Tour and Safaris (Pty) Ltd (“the Company”) and the Client. By paying a deposit, making a booking, or participating in any tour or service provided by the Company, the Client confirms acceptance of these Terms and Conditions.
1. Definitions
- Company refers to People Tour and Safaris.
- Client refers to any individual, group, company, travel agent, tour operator, or representative making a booking with the Company.
- Tour refers to any itinerary, safari, transfer, excursion, accommodation booking, guided service, vehicle rental arrangement, or tourism-related service supplied by the Company.
- Supplier refers to any third-party provider including accommodation establishments, airlines, charter operators, activity providers, vehicle rental companies, transport providers, conservation authorities, and government agencies.
2. Booking Procedure
All reservations are subject to availability at the time of booking.
A booking shall only become confirmed once:
- The required deposit has been received.
- The Company has issued written confirmation.
- All relevant suppliers have confirmed services.
The Company reserves the right to decline any booking request without providing reasons.
Verbal confirmations shall not be considered binding unless confirmed in writing.
3. Quotations
All quotations:
- Are based on current supplier rates and availability.
- Are subject to change without prior notice until confirmed.
- Are normally valid for seven (7) days unless otherwise stated.
- May be withdrawn if accommodation, permits, or transport become unavailable.
Quotations are provided in good faith but do not constitute a contractual obligation until confirmed.
4. Payment Terms
Deposit
A deposit of 50% of the total tour value is required to secure reservations.
Final Payment
The remaining balance must be received no later than 30 days before arrival.
For bookings made within 30 days of departure, full payment is required immediately upon confirmation.
Accepted Payment Methods
- Electronic Funds Transfer (EFT)
- International Bank Transfer
- Credit Card
- Secure Online Payment Link
Bank fees, transfer charges, currency conversion costs, and payment gateway surcharges remain the responsibility of the Client.
Failure to settle outstanding balances may result in cancellation of services without refund.
5. Price Adjustments
The Company reserves the right to adjust prices prior to final payment in the event of:
- Government tax increases.
- National Park fee increases.
- Conservation levy increases.
- Fuel price fluctuations.
- Exchange rate movements.
- Supplier cost increases.
- Legislative changes affecting tourism services.
Every reasonable effort will be made to avoid price adjustments.
6. Cancellation Policy
All cancellations must be submitted in writing.
Cancellation charges apply as follows:

No refunds shall be given for:
- Missed activities.
- Missed transfers.
- Unused accommodation nights.
- Late arrivals.
- Early departures.
- Voluntary itinerary changes during travel.
Certain lodges, flights, charter services, permits, and special events may impose stricter cancellation terms.
7. Refunds
Approved refunds shall only be processed after receipt of funds from relevant suppliers where applicable.
The Company shall not be liable for:
- Exchange rate losses.
- Bank transfer fees.
- Credit card processing fees.
Refund processing times may vary depending on banking institutions and suppliers.
8. Changes by the Client
Any requested change after confirmation is subject to:
- Availability.
- Supplier approval.
- Additional costs.
Changes may include:
- Travel dates.
- Accommodation.
- Activities.
- Passenger names.
- Flight details.
Administration fees may apply.
9. Changes by the Company
While every effort will be made to operate tours as advertised, the Company reserves the right to make reasonable changes where necessary.
Such changes may include:
- Accommodation substitutions.
- Vehicle changes.
- Activity replacements.
- Route adjustments.
- Guide substitutions.
Any substitute service will be of a similar or higher standard wherever reasonably possible.
10. Accommodation
Accommodation descriptions are based on information supplied by the respective establishments.
The Company cannot guarantee:
- Specific room numbers.
- Room views.
- Bedding configurations.
- Lodge facilities remaining unchanged.
Check-in and check-out times are determined by each property.
Additional charges incurred at accommodation establishments remain the responsibility of the Client.
11. Transport and Road Conditions
Namibia is a vast country with extensive gravel road networks and long driving distances.
Travel times provided are estimates only.
The Company shall not be responsible for delays caused by:
- Road conditions.
- Weather conditions.
- Vehicle breakdowns.
- Traffic incidents.
- Government roadworks.
- Accidents.
Clients must follow all safety instructions provided by guides and drivers.
Seat belts must be worn whenever available.
12. Wildlife and Nature Risks
Many tours operate in remote wilderness areas where wildlife roam freely.
Clients acknowledge that:
- Wildlife behaviour is unpredictable.
- Encounters may involve inherent risks.
- Safari activities take place in natural environments.
The Company shall not be liable for injury, loss, or damage resulting from wildlife encounters where reasonable care has been exercised.
13. Passports, Visas and Health Requirements
The Client is solely responsible for obtaining:
- Valid passports.
- Visas.
- Vaccination certificates.
- Health documentation.
- Travel permits.
The Company shall not be liable for denied boarding, denied entry, deportation, or associated costs arising from inadequate documentation.
14. Travel Insurance
Comprehensive travel insurance is strongly recommended.
Insurance should include:
- Medical expenses.
- Emergency evacuation.
- Repatriation.
- Personal liability.
- Cancellation cover.
- Baggage cover.
- Adventure activities where applicable.
The Client travels at their own risk if adequate insurance is not obtained.
15. Limitation of Liability
People Tour and Safaris acts as an intermediary between Clients and independent suppliers.
To the fullest extent permitted under the laws of Namibia, the Company shall not be liable for:
- Personal injury.
- Illness.
- Death.
- Loss of property.
- Theft.
- Delays.
- Flight cancellations.
- Force majeure events.
- Supplier failures.
- Government actions.
- Consequential or indirect damages.
The Company’s liability shall in no event exceed the amount paid by the Client for the affected services.
16. Force Majeure
The Company shall not be liable for any failure to perform obligations where such failure results from circumstances beyond reasonable control, including:
- Natural disasters.
- Floods.
- Droughts.
- Wildfires.
- Epidemics.
- Pandemics.
- Border closures.
- Government restrictions.
- Political instability.
- Civil unrest.
- Strikes.
- Terrorism.
- Acts of God.
No compensation shall be payable under such circumstances.
17. Photography, Video and Marketing Consent
During tours, photographs and videos may be taken by Company staff, guides, photographers, or contractors.
Unless expressly declined in writing before travel, the Client grants the Company a royalty-free, worldwide, perpetual licence to use photographs and video recordings for:
- Website content.
- Social media platforms.
- Digital advertising.
- Trade exhibitions.
- Marketing campaigns.
- Printed promotional materials.
- Public relations activities.
No compensation shall be payable for such use.
Clients wishing to opt out must notify the Company in writing before commencement of travel.
18. Data Protection and Privacy
The Company shall collect and process personal information solely for:
- Reservation purposes.
- Tour operations.
- Supplier confirmations.
- Legal compliance.
- Customer communication.
Personal information shall not be sold or knowingly shared with unrelated third parties except where required for operational purposes or by law.
19. Client Responsibilities
Clients agree to:
- Follow all safety instructions.
- Respect local customs and laws.
- Respect wildlife and conservation regulations.
- Behave responsibly towards fellow travellers and staff.
- Refrain from illegal or disruptive conduct.
The Company reserves the right to terminate participation without refund where a Client’s conduct endangers others or disrupts operations.
20. Complaints Procedure
Should any issue arise during travel, the Client must notify:
- The Tour Guide; or
- Company Management
immediately to allow an opportunity for resolution.
Failure to report concerns during travel may limit the Company’s ability to investigate or provide remedies.
21. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Namibia.
Any dispute arising from or related to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Namibia.
